The Eviction Process
According to California landlord/tenant law, a landlord must give a tenant three days notice to pay back rent or the eviction process will begin. If the tenant has not paid the rent in full after three days have passed, we issue a 60-day notice of lease termination. The tenant then has 60 days to vacate the premises. If the tenant has not left the property within 60 days, we will file an unlawful detainer action and arrange for the sheriff's department to remove the tenant from the property.
Each step in the eviction process is governed by statute and must meet strict requirements. If any of the requirements are not met, the landlord loses the right to reclaim the property and must start the process all over again. We make sure we have all the evidence and documentation in place and prepared correctly.
